Terms of Service

These terms are an agreement between you and Arkaix Labs LLC (“we”, “us”), the owner of Gigometry and gigometry.com, for using Gigometry. By creating an account or using Gigometry, you agree to them and to our Privacy Policy. If you don’t agree, please don’t use Gigometry.
Who can use Gigometry
You must be at least 13 years old (or older if your country requires it). If you’re under 18, a parent or guardian must agree to these terms for you.
Your account
Give accurate information, keep your password to yourself, and tell us if you think someone else has used your account. You’re responsible for what happens under your account. One person per account.
Bands and roles
A band’s owners and admins decide who is in the band and what each member can do. Songs, setlists, the schedule and other content added to a band belong to the band as a group: if you leave, what you added stays with the band. Owners can delete a band and everything in it.
Your content
You own what you create and upload. So we can run the app, you give us permission to store, copy, display and process your content, and to show it to the people you share it with (your bands, your circle, followers, or everyone if you make it public). This permission ends when you delete the content or your account, except for copies other people already have (for example messages they received) and backups that expire on their own.
Only upload what you have the right to share. Charts, lyrics, recordings, photos and flyers may belong to someone else; getting permission is up to you.
Things you must not do
- Break the law, or help someone else do it.
- Harass, threaten, bully or impersonate anyone, or post hateful, sexual or violent content.
- Post spam or misleading ads, or fake reviews.
- Upload content that infringes someone else’s rights.
- Use other people’s contact details for anything other than the reason they were shared.
- Try to get into accounts or data that aren’t yours, disrupt the service, scrape it, or spread malware.
We can remove content and suspend or close accounts that break these rules. You can report people, messages, posts, comments and ads in the app, and block anyone.
Hiring, pay and reviews
Gigometry helps bands and musicians find and work with each other, but we aren’t part of any agreement between them. We don’t employ musicians, guarantee anyone’s work, or process payments. Pay and costs in the app are records for your band. Reviews must be honest and about real work together.
Text messages (SMS)
If you turn them on, Gigometry texts you about your bands: by default when a gig or practice you’re on moves or is cancelled, and anything else you choose in Settings → Notifications (other schedule updates, messages, songs and setlists, or a daily summary). Texts are optional; you don’t need them to use Gigometry.
- Message frequency varies with your bands’ activity and your settings.
- Message and data rates may apply.
- Reply STOP to any text to stop them, or turn them off in Settings. Reply START to turn them back on, and HELP for help.
- For help, email [email protected].
- Carriers aren’t liable for delayed or undelivered messages.
Other services
Gigometry links to and works with other services (for example Songsterr, YouTube, GIPHY and your calendar provider). Their own terms and privacy policies apply to how you use them, and we aren’t responsible for them.
Early access and changes
Gigometry is in early access. Features will change, some may be removed, and the service may sometimes be unavailable. Gigometry is free right now; if we introduce paid features, we’ll tell you the price before you’re charged anything. We may update these terms; if a change is important, we’ll tell you before it takes effect, and continuing to use Gigometry after that means you accept it.
Ending your use
You can stop using Gigometry and delete your account at any time in Settings → Account → Delete my account. We may suspend or close your account if you break these terms or to protect other people, and we’ll tell you unless we’re not allowed to or it would put someone at risk.
Disclaimers
Gigometry is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will always work, be error-free, or meet your needs, and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Always double-check important details like gig dates, times and pay.
Limit of our liability
To the extent the law allows, Arkaix Labs LLC won’t be liable for indirect, incidental, special or consequential damages, or for lost profits, data or gigs, arising from your use of Gigometry. Our total liability for any claim is limited to the greater of US$100 or the amount you paid us in the 12 months before the claim.
Your responsibility to us
If someone makes a claim against us because of content you posted or your breaking these terms, you agree to cover our reasonable costs of dealing with it, to the extent the law allows.
Governing law
These terms are governed by the laws of the State of Mississippi, USA, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Mississippi, unless the law where you live gives you the right to bring it elsewhere.
